Residue reporting for containers arriving in the U.S.

A modified ruling for containers with residue of bulk products arriving in the U.S. will be enforced as of 17th July 2011.

Each container arriving from a foreign port or place with residue may not be manifested or entered as empty. The residue must be manifested, classified, and entered in accordance with statutes and regulations enforced by the U.S. Customs and Border Protection (CBP).

Carriers will be responsible for transmitting advance electronic cargo information for the residual cargo, providing precise cargo description. As these residues risk the ‘safety and security’ of CBP officers who examine them also the actual volumetric amount and weight of the residue is to be included on the manifest. The importer of the goods will be responsible for filing entry documents with the port director, maintaining a valid CBP bond and retaining documentation establishing the basis for determining the value provided for the residual commodity.
